Personal injury is when your body, mind or emotions have been damaged. In legal terms, this is different from when property has been broken. If you’ve been hurt because someone else was negligent, you can sue to get back money you’ve spent, and will spend in the future, because of the other person. You may also be awarded money that punishes the person you’re suing for causing the damage. You can sue both when you are hurt and when someone you are responsible for is hurt.

Personal injury is part of what is called tort law, which covers civil (as opposed to criminal) damages that don’t arise from contracts. Tort defines when someone can be held legally responsible for an injury, whether the person did something by accident or intentionally.

Among the most common types of personal injury claims are assault claims and traffic, work, home, tripping, defective property and holiday accidents. There are also medical, dental and nursing home negligence cases and industrial disease cases.

Generally, attorneys are paid only if you win your suit with part of the money you receive from the persons who are found responsible for causing your injury. There is no fee if you do not win, and payment is not made until the case is resolved.
